Funding of cases
This is obviously an area which concerns most people. We can apply for public funding, formerly known as legal aid, to represent you in court. This is now granted if the Court feels you pass two tests. The first test is if something about you or your case justifies needing a solicitor and the second test is whether your income is limited enough to justify public funding.
Being Appointed by the Court
In some domestic violence allegations and assault cases the Court has the power to nominate a firm to deal with the most serious part of anyone’s defence, the cross examination of the main witnesses. Therefore we may be able to assist you if you are charged with assault but you do not think you will get legal aid. We regularly undertake this work and even if you are refused legal aid by any existing firm, we would be happy to attend a first hearing free of charge to enter a not guilty plea and assist in the case management with you on the basis we would apply to be appointed in this way.
If legal aid is refused, we will normally quote you a fixed fee at the outset of the case. The only additional costs will be any expert evidence that needs to be obtained. This will be explained at the outset. We can also quote an hourly private client rate which is £190 per hour plus VAT.
A straight forward guilty plea in a local court would be a fixed fee of £300 plus VAT.
Trials will be quoted after we have spoken to you and had a brief look at the paperwork as these are obviously harder to give an estimate as to costs. In general, trials start at £750 plus VAT and our quotes rarely exceed £1000 plus VAT.
We are also able to offer a bespoke service if you would like David Smith or Anthony Egan to guarantee to deal with your case throughout and be available for meetings and consultations between any dates of a court case. This is privately funded and will guarantee you the highest level of individual service. There are some cases where this extra opportunity is essential as matters may need to be investigated or evidence preserved, including getting leading Counsel’s opinion at an early stage in the more complex and serious matters. Sensible and fixed quotations will be given on a case by case basis.
